Terms of Service

1. What Passly is
Passly ("Passly", "we", "us") provides software for UK driving instructors, driving schools and learner drivers: a diary, booking, payment, messaging and progress-tracking platform available through this website, the Passly web app and the Passly mobile app (together, the "Service"). By creating an account or using the Service you agree to these terms.
2. Passly is a platform, not a driving school
Driving tuition is provided by instructors, not by Passly. The contract for any lesson, including its price, delivery, quality and any cancellation or refund, is between the instructor and the learner. Passly provides the tools to book, record and pay for lessons, but is not a party to that contract and does not employ or certify instructors. Instructors are responsible for holding the approvals, licences and insurance their tuition requires (including DVSA ADI/PDI registration where applicable).
3. Accounts
- You must give accurate information and keep your login credentials secure; you are responsible for activity on your account.
- Instructor accounts are created at passly.co.uk. Learner accounts are typically created by invitation from an instructor.
- Learners must be old enough to hold a UK provisional driving licence.
- We may suspend or close accounts that break these terms, abuse the Service or create risk for other users.
4. Bookings, cancellations and lesson credits
Bookings made through the Service become agreed lessons when accepted by the other side. Cancellation windows, fees and refunds for lessons are set by the instructor's own policy. Lesson credits purchased from an instructor are redeemable against that instructor's lessons and are governed by the instructor's terms; unused credits are refundable per that policy and applicable consumer law.
5. Payments
Card payments are processed by Stripe under Stripe's own terms; Passly does not store card details. Card payments taken through the Service carry a Passly platform fee of 1.5% of the transaction amount, deducted from the amount paid to the instructor, in addition to Stripe's processing fees. Instructors may also record payments made outside the Service (cash or bank transfer); those payments are between instructor and learner directly and carry no Passly fee. Instructor subscriptions to Passly are purchased on our website and billed as described on our pricing page.
6. Acceptable use
- Don't use the Service unlawfully, or to harass, mislead or spam other users.
- Don't attempt to access data or accounts that aren't yours, probe or disrupt the Service, or reverse-engineer it.
- In-app messaging is for communication between instructors and their pupils about tuition.
7. Your content
You own the content you add to the Service (profiles, notes, messages, reports). You grant us the licence needed to store, process and display it in order to run the Service, including showing instructor profile content publicly where the instructor opts into our directory. You are responsible for having the right to share what you upload.
8. Availability and changes
We work to keep the Service reliable but do not guarantee uninterrupted availability. We may add, change or withdraw features, and will give reasonable notice of changes that materially reduce a paid plan.
9. Liability
Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Otherwise, the Service is provided "as is"; we are not liable for the acts or omissions of instructors or learners, for lessons themselves, or for indirect losses. Our total liability to you is limited to the amounts you paid Passly for the Service in the 12 months before the claim.
10. Ending your use
You can close your account at any time from your account settings or by emailing us. On closure, data is handled as described in our Privacy Policy.
11. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any part of these terms is found unenforceable, the rest still applies. We may update these terms; material changes will be flagged in the app or by email, and continued use after a change means you accept the new terms.
